Equivalent rights for outsourced workers

Legal Framework for Worker Rights in Outsourcing

Article 2 of Labour Law No. 4857 defines the principal employer–subcontractor relationship. Under the conditions specified in that article, the principal employer is jointly liable for the subcontractor’s obligations relating to that workplace arising from the law, employment contracts and collective labour agreements to which the subcontractor is a party.

Scope of the Protection

This provision explains the chain of responsibility for workers’ existing rights in subcontracting relationships. Statutory joint liability is not presented as automatically extending every salary and benefit offered to directly employed university staff to outsourced workers.
